[font=arial, Verdana, 宋体][p=22, 2, left] [b]【《财经》综合报道】[/b] 据正义网消息，因将自己所消费的物品以及与他人打牌Dubo的费用统统由公家埋单报销，近日，浙江省开化县原县长助理、开化古田山国家级自然保护区管理局原局长胡青延被衢州市中级法院一审以贪污、受贿两罪，判处有期徒刑六年。[/p][p=22, 2, left] 今年55岁的胡青延，原系开化县人民ZF县长助理，2002年6月起兼任古田山国家级自然保护区管理局局长。开化县古田山管理局系开化县人民ZF直属事业单位，下设国有独资企业古田山庄。[/p][p=22, 2, left] 经法院审理查明，胡青延在2003至2010年间，利用担任古田山管理局局长的职务便利，先后将自己购置的皮大衣、化妆品、香水、MP4、运动鞋、麻将机、乒乓球桌、箱包等物品的费用，以及自家办酒宴、汽车装饰、与他人Dubo的非法开支以虚开发票的形式在单位财务上报销，侵吞公款共计7.8万余元。2006至2010年间，胡青延还先后5次收受承包古田山综合楼工程的某建筑公司项目经理郑某贿赂的财物，共计价值1.9万余元，并为郑某在工程建设过程中谋取利益。[/p][p=22, 2, left] 胡青延在庭上提出，自己购买的箱包等物品是为了公务出差用，不应认定为贪污；而打牌费用大部分是因为要争取相关部门领导及老乡的帮忙而安排，避免了外出进行其他高消费活动，是工作需要，而且自己也仅仅分得其中的一部分钱，共12800元。对于受贿部分，胡青延也提出其中一部分费用属于人情往来，不应计算在内。[/p][p=22, 2, left] 法院认为，胡青延所在的单位并无为公务出差人员配备物品的规定，其购买的MP4、箱包是为了个人使用，且通过虚开发票的形式在单位财务报销，主观上具有贪污的故意，所涉款项应当认定为贪污。而胡青延发放打牌费用的对象、数额均由他本人决定，应对发放的全部金额负责，打牌Dubo的费用不应由公家报销。另外，胡青延收受郑某贿赂的部分事实清楚，主观故意明显，其属人情往来的辩护意见不予采纳。[/p][p=22, 2, left] 最后，法院以贪污罪判处其有期徒刑五年六个月，并处没收财产人民币2万元；以受贿罪判处其有期徒刑一年，决定执行有期徒刑六年，并处没收财产人民币2万元。[/p][/font] |
