国人爱赌自古皆然，但不论小赌、大赌在国内都违法，若因赌债告上法院，因Dubo违反「公共秩序，善良风俗」被认定不必还。" t( ?" Q$ V/ X
但是，台北地院在最近八个月内，受理来自澳门DC诉请国人偿还积欠赌债的诉讼，法官审理后，一改以往见解，判决当事人必须清偿。' m: s: y) v& L2 P; p
这些诉讼债务人，多主张所欠赌债违背我国公序良俗，以赌债不是债，辩称当初在DC内签字借的钱就不必偿还，甚至辩称在澳门借的是筹码不是现金，但多不为法官採信，原因都缘于澳门法律允许博奕，而DC内规范筹码等同借钱。5 j2 W' F$ d# E1 g" ~) C
债务人的辩解，法院过去基于Dubo是赌徒与赌徒间，或是与庄家（组头）之间的约定，这种Dubo产生的债务，虽然也是债，原因却是基于Dubo行为，有违公序良俗，法官都会判决不必偿还。% u" a5 T: B! d7 n( m* S
例如，艺人猪哥亮躲债多年复出后，有债主兴讼讨债，猪哥亮就曾主张欠的是赌债，藉此规避责任。( L: Y _6 v, z7 `8 A7 j5 K
这种见解已慢慢转变，赌债若发生在开放博奕事业的国家、地区，债权人是可以透过司法诉讼达到清偿债务的目的。( N* f; w: d8 j+ g" X; |
法官就认为博奕事业是澳门ZF核淮经营，为尊重澳门法律，在澳门DC积欠赌债，年满廿岁以上，具完全行为能力者，借钱欠赌债就应受到澳门法律的规范，须如数清偿。3 H) g- l' }* z/ k, L/ v* Q, r& `
代理澳门DC诉讼的理律律师杨代华指出，部分国人在斯维加斯DC内借钱Dubo后不还，业者跨海兴讼，最高法院就曾作过要偿还的确定判决。 |
