彩票大盗连偷10多家彩票点十余万彩票 兑奖落

[align=left][font=simsun][size=14px][p=30, 2, left]李大海年轻时候就犯过刑事大案，2008年出狱后，好吃懒做的他整天无所事事。这些天他在报纸上经常看到有人买彩票中大奖的新闻，顿时他将生活的重点放到买彩票上。李大海的运气开始还不错，10元、100元的小奖中过很多次。但是几个月过后，李大海运气转背，把前面中奖的钱花掉还不算，还把自己一点点小积蓄也赔光了。很快，一个偷彩票的计划在他心中产生了。[/p][p=30, 2, left] 6月15日，在南京秦淮区一彩票点，李大海佯装买彩票，趁老板不注意，将店主放置在一只有机玻璃箱子内的7000余元即开型彩票盗走。随即李大海回家就开始刮奖，收获还颇为丰厚。尝到甜头后，他又接连盗窃了多家彩票点，成为了名副其实的“彩票大盗”。[/p][p=30, 2, left] 2011年5月份以来，秦淮、白下、鼓楼等区连续发生十余起以购买彩票为名伺机盗窃即开型彩票的案件，涉案总价值达十余万元。秦淮警方抽调精干力量全力侦破此案件。随后，警方对各被盗彩票站点进行走访，查询出被盗彩票在傅厚岗、凤凰西街和汉中门的体育彩票点，被多次兑换。据此警方推断嫌疑人还会在这一带兑换。[/p][p=30, 2, left] 不出所料，6月18日下午，办案民警接到店主举报，称嫌疑人正出现在傅厚岗的一个彩票点。侦查员火速赶往现场，但遗憾的是，狡猾的嫌疑人已捕捉到异常，在民警赶到前五分钟已离开彩票点。在问清嫌疑人衣着特征和逃离方向之后，侦查员立即驱车追寻，终于在沿途的一个公交站台附近将李大海抓获。[/p][p=30, 2, left] 目前，李大海涉嫌盗窃已被警方刑事拘留，暂时关押在看守所。秦淮警方也在全力统计李大海所盗彩票的销售价值和中奖金额。据办案民警介绍，遇到类似的案件，涉案案值警方是按照彩票销售价值计算的，而不是中奖金额，因为案值是根据彩票店遭窃后的损失计算的，彩票店的损失即被窃彩票的销售总额。[/p][p=30, 2, left] 如果偷了一万元钱彩票，却中了一百万的大奖，这样的情况下，李大海的涉案案值是否按照中奖金额计算呢？记者就此采访了江苏圣典律师事务所唐迎鸾律师。唐律师说，涉案案值还是应该按照被盗彩票销售额计算，因为彩票中奖具有不确定性和偶然性，行窃者偷彩票时也无法知道彩票能中大奖。偷盗来的彩票中大奖，源头就是违[/p][/size][/font][/align] |
