Seyffart认为，SEC可能没有足够的空间来质疑以太坊的归类，如果SEC将以太坊视为证券，SEC可能会被告上法; c5 |! R/ G' y0 e; s

James Seyffart指出：如果SEC将以太坊视为证券，不只是和整个加密货币产业对抗，还是与姊妹监管机构CFTC: K# I! @6 s$ ?" G) f
唱反调…这就是为什么我认为今年可能会批准以太坊现货ETF的原因。3 S3 B) s. P q1 m0 F9 Q
SEC最近在一起类似诉讼中败诉，SEC在2020年将股票波动率指数SPIKES Index排除在「证券期货」的定义之+ M# H# V/ F$ L6 o
外，认定其为「期货」，但该决定在去年7月被法院推翻，法院称SEC的命令武断且反复无常。# h, C& ^; Z, }
以太坊现货ETF料5月有结果; R$ P7 N5 W2 V. i
贝莱德等7家机构在去年相继向SEC提交了以太坊现货ETF的申请，目前，SEC对VanEck、ARK21Shares和
& q" }* j' L) n2 |- e9 rHashdex以太坊现货ETF的最终审批决定期限为2024年5月，其他申请则在接下来的几个月内。6 g7 E9 C1 U# f6 k
然而，在此之前，SEC必须决定是否批准比特币现货ETF，目前市场正屏息以待SEC是否会在1月10号期限前放行 a8 H& Z0 R% S
比特币现货ETF，福斯新闻昨日报导称，SEC最快或在周五批准ETF，下周正式开始交易。
