建湖一男子沉湎彩票梦想一夜致富，因囊中羞涩竟将目标投向路边的ATM取款机，最终不但分文未获，反而因盗窃罪被判处有期徒刑七年。[p=30, 2, left] 濮某系建湖县人，已过而立之年却无一技之长，至今仍未成家靠打些零工生活。2010年初，一次偶然的机会，濮某晚饭后路过彩票销售点时用随身的两元零钱购买了一张彩票。岂料第二天居然中了200元，濮某顿觉找到一条生财之道，此后便沉湎其中，自己打工所得都用于购买各种彩票，还跟亲戚朋友借钱，但是一直只中些小奖，入不敷出。[/p][p=30, 2, left] 为了筹集彩资、偿还借款，濮某将目标盯上了路边的ATM取款机。2010年12月19日凌晨1时许，濮某在建湖县某镇农村商业银行自动取款机房间内，用随身携带的起子、凿子撬挖ATM机出钞口，意图窃取取款机内现金，后银行报警器发出报警声音，濮某慌忙逃离现场。第二天，侦查人员通过监控录像锁定濮某，并将其抓获。[/p][p=30, 2, left] 经查，濮某盗窃时，取款机内有人民币124400元。庭审期间，濮某对自己所犯罪行供认不讳，请求法院从轻处罚。[/p][p=30, 2, left] 建湖法院经审理后认为，被告人濮某以非法占有为目的，采取秘密手段，盗窃公私财物，数额特别巨大，其行为已构成盗窃罪。庭审中被告人的认罪态度较好，酌情从轻处罚。遂依法作出上述判决。[/p] |
